OFFICIAL RULES OF THE CONTEST
"PHUKET 7 NIGHTS GIVEAWAY"
I. ORGANIZER
The organizers of the "Giveaway Phuket 7nights" Contest (the "Contest") are: Company Z TOUR SRL, with headquarters in Cluj Napoca, Str. Anatole France, no. 62, postal code 400463, jud. Cluj, registered with the Trade Registry under number J12/283/2002, VAT registration code RO14457429, legally represented by administrator Ioana Tulai.
The Organizer is the initiator of the Contest and assumes responsibility for its smooth running, meaning that it also has the right to amend or supplement the Rules during the Contest, with the obligation to publicly announce the changes and / or additions made, in the same manner as the initial information was made.
The promoters of the contest are the Instagram pages @pricopsxcape and @nomadia.travel
II. PURPOSE OF THE CONTEST
The aim of the contest is to reward clients with 7 nights accommodation at a hotel in Phuket, Thailand.
III. DURATION OF THE COMPETITION
The contest is launched on 05.05.2024 and people can participate until 19.05.2024 inclusive.
The draw will take place within 48 hours of the end of the competition. The winner will be announced on the Organizer's social networks within 48 hours from the end of the contest.
IV. VENUE
The contest will take place on the social networks of the Organizer: Instagram.
V. CONDITIONS FOR PARTICIPATION IN THE CONTEST
The contest is open to all individuals aged 18 or over on the date of participation.
The conditions of participation are as follows: follow the Z TOUR page on Instagram; follow PRIXCOPSXCAPE on Instagram; follow NOMADIA.TRAVEL page on Instagram; Mentioning someone in a comment and liking the post with the giveaway.
Employees, associates or collaborators of the Organizers, nor first-degree relatives (parents, children) and their spouse cannot participate in the Contest.
VI. DESIGNATION OF WINNERS AND PRIZE OFFERED
The winner of the contest is determined by drawing lots, through the randomorg.com System randomorg.com. It is one that is widely used and has a very high degree of trust among users. However, the Organizer does not assume any system errors that may occur and which are not its fault.
1ST PRIZE
The prize offered is: 7 nights accommodation at a 4-star hotel in Phuket, Thailand with breakfast included anytime between November and March except December 20, 2024 -January 10, 2025.
VII. PROCEDURE FOR CLAIMING, VALIDATING AND RECEIVING THE PRIZE
The winner will be announced on the Organizer's social networks within 48 hours of the end of the contest. In this regard, by participating in the Contest, participants agree to the publication of their data (name, surname) on the social networks of the Organizer if they are designated winners.
In order to receive the prize offered by the Organizer, the winner will contact the Organizer by email at marketing@ztour-travel.ro address to communicate his contact details in order to deliver the prize.
If the winner does not contact the Organizer within maximum 3 days from the announcement of the winner or does not communicate to the Organizer the data requested for delivery of the prize within 3 days from the date of the request or refuses the prize, the winner will be invalidated and a new winner will be designated, in the next order of the draw.
If the prize cannot be awarded to the next winner for the reasons outlined above, it remains with the Organizer.
VIII. INTERRUPTION. TERMINATION OF THE CAMPAIGN
The campaign may be interrupted only for determined durations and/or may cease only in case of force majeure as defined by law and/or by a unilateral decision of the Organizer, but not before announcing the public by displaying it on the Organizer's website and Facebook and Instagram pages.
The campaign may cease, be interrupted or suspended at any time based on the decision of the Organizer, without thereby creating any right to compensation in favor of the participants.
IX. DISPUTES
Any possible complaint, including on how to validate a prize, may be formulated in writing by the participant and submitted personally or sent by mail, within one calendar month from the end of the Campaign, to the address of the Organizer. The appeal will be settled within maximum 5 (five) working days from receipt. If the contestant is dissatisfied with the decision, the appeal will be resolved amicably.
If amicable settlement of disputes will not be possible, they will be submitted for settlement to the courts of Cluj-Napoca.
X. DATA PROTECTION
In order to carry out the Campaign, the Organizer will process personal data belonging to participants in accordance with EU Regulation 679/2016 and all relevant legal provisions.
The Organizer, as a Personal Data Operator, may transmit personal data that participants provide to affiliated companies and / or to other partners and collaborators with whom it has established contractual relations in order to carry out the Campaign and fulfill its legal obligations. The transmission of personal data to third parties takes place on the basis of a confidentiality commitment on their part and an assumption of data protection.
The personal data processed within the Campaign are: name, surname, email address, telephone number, IP, residence/domicile address.
When accessing the site for registration, certain information about the participants' device is automatically collected, such as browser information, IP address, time zone and some cookies installed on the device.
The purpose for which personal data is processed: to make it possible to participate in the Campaign, to make it possible to participate in the prize draw, to respond to possible complaints, to be able to deliver the prize, to tax the prize offered.
Grounds for processing: data processing is necessary to make it possible to participate in the Campaign and award prizes.
It is possible for certain processing operations to be carried out on the basis of express consent in this regard by ticking the corresponding boxes.
Duration of storage and processing of personal data: is the duration necessary to fulfill the purposes for which the data were collected and in any case for the period required by the applicable legal regulations.
Data security measures: The Organizer ensures appropriate technical and legal measures to ensure effective protection of personal data belonging to persons who provide us with such data.

We are careful to ensure your right to receive clear, transparent, understandable and accessible information on how we process your data, including details of the rights you have in this regard and which are also presented in this document.
- Right to rectification – if you find that your personal data that we process are incorrect, incomplete, inaccurate, you can rectify them or complete them by a simple request for rectification sent to marketing@ztour-travel.ro
- the right to delete data ("the right to be forgotten") – you can obtain the deletion of data, if their processing was not legal or in other cases provided by law, Data deletion may take place in any of the following situations:
a) we no longer need the personal data to fulfill any of the purposes for which we previously processed them;
b) you withdraw your consent on the basis of which we previously processed you and there is no other legal basis on which we can rely on future processing;
c) you object to data processing when we process data for direct marketing purposes (including, profiling for direct marketing purposes),
d) you oppose data processing based on our legitimate interest and we cannot demonstrate that we have legitimate reasons that justify the processing and prevail over your interests, rights and freedoms;

f) personal data must be deleted to comply with our legal obligations.
We may reject your request to delete your data if:
(a) we must comply with legal obligations to retain data;
(b) if the data are necessary for us to establish, exercise or defend our legal claims.
- the right to restrict processing - you may request restriction of processing in cases where:
a) contest the accuracy of the data for a period that allows us to verify the correctness of the data;
b) the processing is illegal, but you oppose the erasure of personal data, requesting the restriction instead;
c) if the Operator no longer needs the personal data for processing, but you request them for the establishment, exercise or defense of a right in court or before arbitration bodies;
d) if you have objected to the processing, for the period of time in which it is verified whether our legitimate rights prevail over your rights.
- the right of opposition – you can oppose in particular data processing that is based on our legitimate interest.
- the right to data portability - you can receive, under certain conditions, the personal data you have provided to us, in a format that can be read automatically or you can request that the data be transmitted to another operator
- the right to file a complaint - you can file a complaint about the processing of personal data with the National Supervisory Authority for Personal Data Processing (ANSPDCP).

-the right to withdraw consent – in cases where processing is based on your consent, you can withdraw it at any time.
The withdrawal of consent will have effects only for the future, the processing carried out prior to the withdrawal remaining valid.
- the right not to be subject to additional automated decisions or profiling related to automated decisions: you can request and obtain human intervention regarding that processing or you can express your own point of view on this type of processing

We do not want to collect or process data of minors under the age of 18. The campaign is addressed exclusively to persons aged 18 at the time of registration in the Contest.

XI. FINAL PROVISIONS
The Rules of the Contest are available, free of charge, on the Organizer's website, throughout the Contest.
Participation in the contest implies the obligation of participants to comply with the provisions of this Regulation and the applicable legislation.
The Organizer reserves the right to amend these Regulations, any changes entering into force after they are made public by publishing the Rules on the Organizer's website in the updated form. Participants have the obligation to check the up-to-date version of the Regulation whenever they access the Campaign page.
The organizer undertakes to calculate, withhold and transfer the tax due for the prizes awarded to the winners in accordance with the legislation in force on income tax. Any other obligations of a fiscal or any other nature in connection with the prize are the sole responsibility of the winner.
